Terms of Service
Effective 2026-04-20. These terms form a binding agreement between halopos Pty Ltd and the merchant operating a halopos tenant.
1. The service
halopos provides a multi-tenant SaaS point-of-sale platform hosted in Australia. Subject to these terms, we grant the merchant a non-exclusive right to access the service for their own hospitality operations.
2. Fees & pricing model
The merchant selects one of three pricing models: customer surcharge, merchant percent of GMV, or flat subscription per location. Fees are billed monthly in arrears via Stripe. The merchant may switch pricing models at the end of a billing cycle via /admin/billing.
3. Acceptable use
The merchant must comply with our Acceptable Use Policy and all applicable Australian laws.
4. Data ownership
The merchant retains ownership of their tenant data. halopos acts as the data processor for that data. We retain ownership of the software, aggregate anonymous usage statistics, and operational telemetry.
5. Availability
We target 99.5% uptime at M2 and 99.9% uptime at GA. The live SLA is published on status.halopos.app once GA ships. Planned maintenance windows are announced at least 48 hours in advance.
6. Termination
Either party may terminate for material breach after 30 days' notice. On termination the merchant may export all tenant data via /admin/privacy for 90 days, after which we will delete it.
7. Liability
To the maximum extent permitted by the Australian Consumer Law, halopos's aggregate liability is capped at the fees paid by the merchant in the 12 months preceding the claim.
8. Governing law
These terms are governed by the laws of New South Wales, Australia, and the parties submit to the non-exclusive jurisdiction of its courts.
